Fairfax County Released over 200 Illegal Alien Criminals Since Feb—Including Alleged Child Rapist

Child sex predators, rapists, repeat offenders, and fugitives from justice are among those released to the streets despite ICE detainers.
A FOIA request by Restoration News reveals that the sanctuary jurisdiction Fairfax County has released 205 illegal alien criminals onto the streets since February 2025. Only 7 arrested criminals were turned over to Immigration and Customs Enforcement (ICE). Among those released to the streets—rather than taken into ICE custody—were violent criminals including an accused child rapist, child sexual predators, fugitives from justice, and over a dozen charged with malicious wounding or strangulation.
Democrats’ sanctuary policies protect violent illegal aliens at the expense of the safety of Americans—including children.
Here is a portion of the charges against the illegal aliens released to the streets in Fairfax since February:
Vehicular manslaughter with a DUI
10 charges related to child sex crimes, including:
Rape of a victim under 13
Aggravated sexual battery of a child under 13
Forcible intercourse with victim under 13 and aggravated sexual battery with 2 victims under 13
Procuring a minor for prostitution, sodomy, porn
DUI with a child passenger (driver’s blood alcohol content >.20)
19 first-time DUI offenses
5 second-time DUI offenses and 1 third-time offense
12 charges of strangulation
49 charges of burglary, robbery, or larceny
1 stabbing and 13 assaults including one against a law enforcement officer
In addition, we found over 30 charges of criminal illegal aliens failing to appear in court to face their crimes.
These monsters could be your next-door neighbor if you live in northern Virginia—but Fairfax Sheriff Stacey Kincaid apparently doesn’t want you to know their names.
Kincaid’s office redacted the names of these criminals in the documents provided to Restoration News—even though other Virginia sheriffs provide this information upon request.
And Fairfax County, a sanctuary, shields these criminals from deportation even after ICE issues detainers.
A spokesperson for Kincaid told Restoration News they would only hold an inmate for ICE if “there is a judicial order authorizing us to hold a person.”
Harboring Violent Criminals
In 2021 the Fairfax Board of Supervisors adopted a so-called “Trust Policy” that harbors illegal aliens, even if they’ve committed violent crimes. This policy requires an administrative warrant to be issued before local law enforcement may cooperate with ICE. It also prohibits any county funds from being used in the enforcement or investigation of immigration violations.
The policy refers to illegal immigration issues as “civil” violations rather than criminal; yet 8 U.S.C. 1325 of the federal criminal code declares unlawful entry and failure to depart to be a criminal, not civil, offense.
The Justice Department clarified this in a June opinion, saying section 275 of the Immigration and Nationality Act regards illegal entry into the United States as a criminal offense. In February, Gov. Glenn Youngkin (R) ordered state law enforcement and corrections officers to fully cooperate with ICE. Unfortunately, his only mechanism against local jurisdictions is to withhold funding, but so far the Democrat-controlled legislature has blocked even that from happening.
Lt. Gov. Winsome Earle-Sears, a legal immigrant and naturalized citizen, said, “We’ve seen too many tragic stories after dangerous criminals in this country illegally were put back on the streets, and this Executive Order will make sure we send them back to where they came from.”
Sanctuary counties and cities like Fairfax create an unsafe environment not only for themselves but for the entire commonwealth. Will voters wake up to the dangers of leftist policies in time to choose leaders this November who will fight against radicals like those in Fairfax?
